Website Terms of Use
The rules for using this public website, sending a project enquiry, and relying on the information presented here.
Last updated: July 15, 2026
Using the website does not create a client relationship or commit either side to a project.
A signed project agreement—not website copy—controls scope, ownership, price, warranties, and delivery obligations.
Use the site lawfully and do not submit sensitive or confidential information before a suitable agreement is in place.
Agreement to these terms
These Terms of Use govern your access to this website operated by NexGen Developers. By using the site, you agree to these terms. If you do not agree, do not use the site.
These terms apply to the website itself. Any paid project, consultancy, support, or other client service begins only under a separate written proposal, statement of work, contract, or other agreement accepted by the relevant parties.
Website information is not a service commitment
The site describes our capabilities, approach, representative work, and general thinking. It is provided for informational purposes and is not an offer, guarantee, professional advice, or promise that a particular service, result, price, team member, technology, or timeline will be available.
Project estimates, schedules, responsibilities, deliverables, warranties, intellectual-property terms, and commercial outcomes are governed only by the applicable signed client agreement.
Project enquiries
You may use the project planner to request a conversation or share a brief. Submitting a form does not create a client relationship, confidentiality obligation beyond applicable law, exclusivity, or a commitment by either party to proceed.
Do not submit confidential trade secrets, credentials, payment details, regulated information, or sensitive personal data before an appropriate agreement and secure exchange method are in place. You confirm that information you submit is accurate and that you have the right to provide it.
Permitted use
You may access and use the site for lawful personal or business evaluation. You may not:
- Interfere with the site, probe or bypass security, introduce malicious code, or overload infrastructure.
- Use automated extraction in a way that violates applicable law, published technical controls, or materially disrupts the service.
- Misrepresent affiliation with NexGen, impersonate another person, or submit deceptive or unlawful information.
- Copy, republish, sell, or exploit substantial site content or visual identity except where law permits or we give written permission.
- Use the site or its content to infringe rights, commit fraud, distribute harmful material, or support unlawful activity.
Intellectual property
Unless stated otherwise, this website’s original code, brand identity, copy, visual design, graphics, and other content are owned by or licensed to NexGen and are protected by applicable intellectual-property laws.
Product names, libraries, frameworks, and third-party marks remain the property of their respective owners. References to technologies or anonymised work do not imply endorsement, partnership, or ownership of third-party brands.
Client-project ownership is not determined by these website terms. It is set out in the applicable project agreement.
Representative work and claims
Some portfolio material is anonymised or describes internal work. We aim to label that context clearly. Unless expressly stated and verifiable, examples do not represent a promise that another project will achieve the same outcome.
Business results depend on factors outside our control, including the offer, market, traffic, pricing, operations, decisions, content, and client implementation.
Third-party services and links
The site may depend on or link to third-party services, including hosting, email delivery, code libraries, or external websites. Those services are governed by their own terms and may change or become unavailable.
We are not responsible for third-party content, security, availability, or practices merely because we provide a link or integration. Review their terms before using them.
Availability and changes
We may change, suspend, restrict, or discontinue any part of the site, correct errors, or update content without notice. We do not promise uninterrupted, secure, or error-free availability.
We may revise these terms by posting an updated version and changing the date above. Continued use after the effective date means the revised terms apply to future use.
Disclaimers
To the maximum extent permitted by law, the website and its content are provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.
Nothing in these terms excludes a warranty or right that applicable law does not allow us to exclude.
Limitation of liability
To the maximum extent permitted by law, NexGen and its team will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss arising from website use, including loss of profit, revenue, data, opportunity, goodwill, or business interruption.
For claims arising only from use of this free public website, our aggregate liability will not exceed the greater of the amount you paid us specifically for that website access in the previous twelve months or USD 100. This limitation does not apply where liability cannot legally be limited.
Governing law and disputes
These website terms are governed by the applicable laws of Pakistan, without regard to conflict-of-law rules, unless mandatory consumer or local law requires otherwise.
Before starting formal proceedings, both sides should make a reasonable good-faith attempt to resolve the issue through written communication. Courts with lawful jurisdiction in Pakistan will have non-exclusive jurisdiction, subject to rights that cannot be waived.
